So in short. I bought a Westfield from a garage over a year ago on the promise that they'd get it through its IVA. 3 attempts later and a lot of p*ssing about and broken promises I've asked for my money back.
And their response. No because I've entered into a contract to purchase! After a lot of tooing and froing eventually their next offer was that they would give me my money back when they have sold the (my) car. I told them this was unacceptable as the vehicle/buying experience fails on all of the tests on the Sale of Goods Act and I should be refunded.
Their last offer today was that they were going to pay me something when either the Westfield or another car has been sold.
I am thoroughly fed up and still out of pocket with no car.
Does anyone have any good ideas other than taking them to court? I have neither the time nor inclination to go through this process if possible.

If you went down the small claims route you would have to give them reasonable notice and an opportunity to resolve the issue by way of a letter. Worth checking out the which website on small claims, there's a template available. Sorry I can't posts any links at present. Given that they are bending a little this may be enough to get them to pay up promptly if they have the means. If you then have to pursue it, a small claim isn't too onerous, though bear in mind there's a limit of 10k. If the claim is over that amount then it would involve solicitors etc which means complicated and costly.

Maybe try and negotiate part payment from them as a gesture of their intentions to get the amount down then consider options?
