So my nephew was in his car this morning, drove up to a junction at low speed, car already there but slightly to one side (curb side) stopped with room, once he (nephew) was stationary the driver in front started without any warning and no indication to reverse, nephew starts to sound horn but impact was inevitable causing quite a lot of damage to the bumper,with and moved bonnet to one side so a lot seeing as my nephews car is brand new, impact car then gets out and tries today my nephew is at fault as he was too close to him and should of known what he (impact driver) was doing, he then went on to say I’m not admitting liability for this so you’ll have to go through your insurance and let them decide, I’ve googled some stuff but it seems to be a bit of a grey area plus the insurance company (nephews one) said 95% of these sort of impacts end up 50/50 as there’s no proof my nephew didn’t hit him
I can’t believe all this seeing as this blokes a middle aged guy (50 odd) not some chancer, any legal bods on here that could give some advice ??

From my experience the insurance won’t fight the case unless you can prove it (dashcam?) they will just go with you’ve hit the back of the other car it’s your fault no matter what really happened He will have quite a battle to get them to do much they don’t seem very interested and just want to pay out and get it out of the way.

But saying that we have recently had someone roll back about 4 ft into one of our buses and tried to claim of us but we had it on camera so the insurance have just thrown it out after seeing the evidence.
I hope he gets the right result and not stitched up by them

Really sorry to hear that, that’s a crappy and unfair position for young driver. Sadly age is not correlated to being an ars**ole.

I’m not legal but my wife works for an insurance firm and I have worked with police and legal types a lot. It’s amazing how hard it is to deal with unpleasant and nasty people even with bags of evidence.

As Matt said, unless there are any other witnesses or video evidence, that’s going to be tricky. Any chance that nearby cctv or local businesses may have saw/caught it?

If it ends up anything less than 50:50 unfavourably against your newphew, plead discrimination. I hope he gets a positive outcome.

guessing he is hoping a young bloke with sky high insurance would rather cough up cash? or did he not offer that(even if he didnt dont mean he isnt waiting for you too) call me suspicious but sounds bit scammy to me?you could always find a witness...look really hard

Dash cams are the only way foward these days. A video cant lie. If it was law to have one fitted this type of bull crap and crash for cash would hardly happen as they wouldnt get away with it.

Agree Jay, last two times I had collisions the near mention of my dash cam seemed to have an effect, the real trick is to keep it running and try to get them to admit it on camera, then tell them about the camera.

good job your nephew had 2 RELIABLE witnesses in the car.....otherwise i figure it'd end up 50/0 at best.
